1. Introduction

These Terms and Conditions (“Terms”) govern the manner in which GeoENERGY Holdings and its subsidiaries (GeoENERGY Africa (Pty) Ltd, GeoENERGY Services (Pty) Ltd, GeoWIND (Pty) Ltd, GeoWIND Services (Pty) Ltd, GeoENERGY Investments (Pty) Ltd, collectively referred to as “GeoENERGY”) process and protect your personal information in compliance with the Protection of Personal Information Act, No 4 of 2013 (“POPIA”).
The term “party” refers to any individual, client, service provider, employee, or other entity interacting with GeoENERGY.

For employees, GeoENERGY may collect and process personal information including but not limited to:

  • Identification and passport numbers

  • Gender, marital status, nationality

  • Health and medical history

  • Race or ethnic group

  • Contact details (email, physical address, telephone numbers)

  • Employment history, language, next of kin details

  • Bank account details

The purpose of processing this information includes:

  • Fulfilling employment obligations

  • Protecting the legitimate interests of employees

  • Compliance with statutory obligations

2.2 Clients

For clients, GeoENERGY may collect and process personal information including but not limited to:

  • Names and surnames

  • Identification and passport numbers

  • Nationality

  • Contact details (email, physical address, telephone numbers, GPS coordinates)

  • Bank account details

The purpose of processing this information includes:

  • Communicating directly with clients

  • Performing under procurement and service agreements

  • Marketing

  • Compliance with legal obligations


3. Sources of Personal Information

Personal information may be collected:

  • Directly from you as an employee, client, or business relation

  • From statutory institutions (e.g., CIPC, SARS)

  • From public sources

  • From GeoENERGY’s internal records

GeoENERGY may disclose your personal information to:

  • Statutory institutions (e.g., CIPC, SARS)

  • Relevant public or equivalent entities

  • Third parties agreed to in writing by you

By continuing to engage with GeoENERGY, you:

  • Consent to the processing of your personal information as outlined

  • Acknowledge that withholding consent may affect GeoENERGY’s ability to provide services or fulfill contractual obligations

  • Indemnify GeoENERGY against claims arising from unauthorized consent granted on behalf of third parties

If you do not consent to the processing of your personal information, you may opt out by notifying GeoENERGY.

You further acknowledge that in certain instances, GeoENERGY may process personal information without explicit consent, such as for legal obligations, investigations, or when information is publicly available.

  • Access the personal information held by GeoENERGY

  • Request correction or deletion of your personal information

Withdrawal of consent must be submitted in writing to the GeoENERGY Information Officer at contact@geosun.co.za.

Please note that withdrawal of consent may limit GeoENERGY’s ability to deliver certain services or benefits and will not affect any processing carried out prior to withdrawal.


7. Direct Marketing

You may opt out of receiving direct marketing communications at any time by:

  • Following the unsubscribe instructions in any marketing communication, or

  • Contacting the GeoENERGY Information Officer at contact@geosun.co.za.


8. Access to Personal Information and Lodging Complaints

To request access to your personal information:

  • Submit a written request to the GeoENERGY Information Officer at contact@geosun.co.za.

  • You may be required to provide proof of identity.

  • A reasonable fee may be charged for providing copies of personal information.

Requests for access may be declined under certain conditions, such as:

  • Legal privilege

  • Confidentiality obligations

  • Third-party privacy concerns

  • Prohibited disclosure under law


9. Updates to These Terms

GeoENERGY reserves the right to update or amend these Terms from time to time. Updated versions will be published accordingly, and continued interaction with GeoENERGY will be deemed acceptance of the updated Terms.
